Here's all the legals related to the competitions we run. Yes, I know it might seem like we're trying to 'own yo' ass', but in reality we're just trying to give you lots of chances to win great prizes through fun competitions on Cam FM without some no-win-no-fee chump trying to sue us for a fast buck every five minutes. Capisce?
General Terms and Conditions
These terms and conditions apply to all competitions run by Cam FM whether they are on-air, via the Cam FM website, or at an event attended by Cam FM.
- Definitions:
- "General Terms" refers to these terms and conditions which apply to all Cam FM competitions unless otherwise stated.
- "Specific Terms" refers to additional terms and conditions which may be applied to specific competitions. Where this is the case, Specific Terms will appear on this page below the General Terms under the relevant competition title heading.
- "Terms" refers collectively to the General Terms plus any Specific Terms which are applicable to the competition being entered.
- "You", the "Entrant", the "Participant" means you the person taking part in a competition.
- "Cam FM", "Us", "We" means authorised persons acting on behalf of Cambridge and Anglia Ruskin Student Radio Limited such as programme presenters and producers.
- The "Competition", "Contest" or "Game" refers to the Cam FM competition you are entering.
- The "Promoter", is the person or company legally responsible for operating the competition and any such prizes awarded. Unless any Specific Terms state otherwise, the promoter shall be Cam FM, Cambridge and Anglia Ruskin Student Radio Limited.
- Scope of terms and conditions:
- General Terms shall apply to all Cam FM competitions.
- Specific Terms shall apply to the Cam FM competition corresponding to the title of those Specific Terms.
- Where a contradiction exists between a clause(s) within the Specific Terms and a clause(s) within the General Terms, the clause(s) of the Specific Terms shall take precident.
- In the event that any provision of these General Terms or Specific Terms are held to be void, illegal, invalid, or otherwise unenforcable the provision shall be removed from the remaining provisions which shall continue in effect.
- By entering a competition, you agree to be legally bound by these General Terms and any relevant Specific Terms.
- These terms and conditions shall be governed in accordance with the laws of England and Wales.
- Eligibility for competitions:
- Cam FM Competitions are open to anyone over the age of eighteen (18) years who has not otherwise been barred from competing in Cam FM competitions and satisfies at least one (1) of the following criteria:
- is a current member of the University of Cambridge, or
- is a current member of Anglia Ruskin University in Cambridge, or
- is a member of staff of the University of Cambridge, or
- is a current member of staff of Anglia Ruskin University in Cambridge, or
- is a member of staff of any organisation in which the University of Cambridge is a majority shareholder, or
- is a member of staff of any organisation in which the University of Cambridge is the major affiliated body, or
- is an employee of Cambridge University Hospitals NHS Foundation Trust, or
- is a member of the Homerton School of Nursing, or
- is a visiting student or visiting researcher at the University of Cambridge, or
- is an alumnus or alumna of the University of Cambridge, or
- is an alumnus or alumna of Anglia Ruskin University in Cambridge, or
- has their normal place of residence within 10 miles of the Great St Mary Church, Market Square, Cambridge; or
- has their normal place of work within 10 miles of the Great St Mary Church, Market Square, Cambridge, or
- normally resides on land owned by the University of Cambridge or any of its colleges.
- Cam FM reserves the right to impose a ban on participants for any length of time deemed appropriate for actual or suspected breach of these Terms.
- Persons barred from entering Cam FM competitions will not be eligible and have their entries discarded at discretion of Cam FM with Cam FM waiving all liability for any cost of entry.
- Persons referring a competition to Ofcom shall automatically forfeit their entry to all Cam FM competitions, and automatically be barred from future competitions until the relevant Ofcom investigation is closed.
- Decisions of whether eligibility criteria have been met are the sole discretion of Cam FM.
- Proof of eligibility may be required before collecting any prizes associated with the competition.
- Presenters, co-presenters, producers, writers, assistants and their families of a programme conducting a competition may not enter the competition.
- Cam FM members who are not otherwise involved with the programme hosting a competition may be eligible for entry subject to the other clauses within this "Eligibility for competitions" subsection.
- Entries and entry methods:
- Unless stated in the Specific Terms, only one entry per person is permitted per competition. Multiple entries from the same person or from syndicates will result in all entries by that person or syndicate being discarded unless Specific Terms permit such an entry.
- For an entry to be deemed valid, it must be submitted by an eligible person before the competition deadline, using the specified entry method(s) of the competition.
- Unless stated in Specific Terms, the entry method(s) shall be determined by the Host and publicised on-air or online at the time of competition opening.
- Should no Specific Terms apply to a competition regarding open period and entry method(s) nor entry method(s) and open period be specified by the host, the default entry methods shall apply:
- Entry may be by e-mail, online message form, or SMS text
- The competition shall open the moment it is first announced
- The competition shall close once the conclusion of the competition is announced, or the programme in which the competition was opened finishes, whichever is sooner; unless otherwise stated.
- Entries are deemed to have been made the moment they are received in the Cam FM studio, not when they are sent.
- Cam FM is not responsible for any loss or damage incurred by the participant or third parties as a result of the participant entering a competition.
- Defective entries include entries which are inaudible, incomprehensible, damaged, incompleted or unintelligible. Defective entries will be discarded.
- SMS: where a competition may be entered by SMS, the participant is wholly liable for their costs of sending the SMS message. Requirements for entering via SMS include legally possessing a valid mobile phone with an account which has sufficient permissions granted by the mobile phone service provided to send an SMS message to our number.
- Cam FM is not liable for SMS messages which fail to be delivered before the competition deadline.
- Emails: where a competition is entered by e-mail, Cam FM is not responsible for the content of participants e-mails, any loss or damage incurred by sending the entry, nor for failure for an entry to arrive due to being rejected by our mailservers.
- Telephone calls: we reserve the right to move on to the next participant should a participant fail to answer their telephone in time without liability. We are not liable for a defective entry caused by telephone connection cutting out, engaged lines or reducing in quality to make it inaudible.
- Other methods: entries received via other methods including, but not limited to, Facebook, Twitter, BanterBridge; may or may not be included at our discretion unless specifically allowed in the Specific Terms. We are not responsible for the failure of entries to arrive or arrive intact through such other methods.
- Entries which do not conform to the correct format required by the competition shall not be valid. An incorrect format in this instance includes but is not limited to supplying an incorrect answer to a competition question.
- All participants certify that they are in adequate physical and mental health to fulfil the criteria or activities required by a competition. Where the participant has any level of doubt whatsoever about such certification, they must obtain such certification from their GP. Cam FM is not liable for any costs, loss or damages incurred as a result of seeking such certification.
- Entries made through the use of automated entry systems will be deemed invalid and discarded.
- Should an entry require a person to submit a work of art, a photograph, a drawing or video clip (the "Material") as part of a competition, the participant:
- warrants that they have advanced permission of all the persons identifiable in the Material for it to be used in such a way, and
- certifies that they own the copyright to the Material, or have permission from the copyright owner(s) to use the Material under these Terms, or certifies that the Material is in the public domain; and
- warrants that the Material does not infringe the intellectual property of a third party, and
- warrants that the Material is not harassing, threatening, discriminatory or illegal in way,
- grants Cam FM express permission to edit, alter, create derivative works and republish the Material at any point from the moment of entry without Cam FM incurring any liability or fees, and
- agrees that Cam FM cannot be held liable for any loss, damage, defamation or infringement through the use of the Material, and
- waives their right to obtain an injunction against the use of the Material unconditionally.
- The participant assumes all responsibility and liability in obtaining time off work or study to participate in a competition.
- Winner selection:
- Unless stated in the Specific Terms, selection shall be done via a process described by the Host at the time of publicising the competition.
- In the event that the selection process is not stated in Specific Terms and not stated or described by the host the following default process shall be applied:
- The winner shall be selected at random from valid entries received
- In the event that the competition winner is to be selected on the basis of the first entry received ("Fastest First"), Cam FM shall not be held liable for any costs or losses incurred by other participants in submitting an entry beyond the moment the first entry is received.
- The following abbreviations may be used to refer to the corresponding process of winner selection:
- "Fastest First" or "Fastest Finger First": the winner will be the person responsible for the first valid entry received after the competition opens and before the competition deadline.
- "Closest to" or "nearest to": the winner shall be the person who submits an entry which is mathematically the least distance away from the correct answer in the case of a number, or semantically most similar in the case of a non-numerical value. Where two equal entries are received, the final winner will be selected at random from those entries.
- "The best" or "judged to be the best": the winner shall be the person responsible for the entry deemed by the Host to contain one of, the highest aesthetic quality among entries, the most creative quality among entries, the most amusing among entries, the most tasteful among entries. Where two entries are given equal merit under this method, the final winner will be chosen at random.
- "Out of a hat": the winner will be selected at random from valid entrants.
- "Most lively" or "most exciting" or "most enthusiastic": the winner will be selected as the entrant who demonstrates the most appropriate attitude and/or sound for broadcast.
- Any random selection will be performed using an unweighted digital random number generator with numbers assigned in an equal manner to valid entries.
- Where no winner is selected under the original competition Specific Terms or process stated by the Host, Cam FM reserves the right to modify the selection criteria.
- Winners who are later deemed to be ineligible to enter or whose entries were later deemed to be defective will not be entitled to any associated prizes.
- Prizes:
- Where no prize has been stated by Specific Terms or the Host, no prize will be offered and participants should be aware that the competition is held just for fun.
- Prizes offered by Cam FM are usually provided to us by a third party or sponsor. At the end of the competition the liability passes from Cam FM to the sponsor for the delivery of the prize offered. If the sponsor or third party thereafter cannot deliver the product or prize due to liquidation or similar, Cam FM is not liable.
- Prizes are awarded to competition winners based upon the these terms and at the discretion of the Cam FM Programme Controller. No correspondence will be entered into.
- There is no cash alternative for prizes.
- Prizes are non-transferrable.
- Where a prize becomes unavailable, Cam FM will request that the supplier of the prize provide an alternative at equal or greater value. Cam FM is not responsible for the sponsor's failure to deliver such prize and liability of provision passes to the supplier.
- Cam FM disclaims liability for any loss or damage caused by the collection, receipt or usage of a prize.
- Cam FM disclaims liability for any loss, damage or distress caused by the prize received differing to that described during the competition.
- Prizes must be claimed within 28 days of the announcement of the winner. Winners may contact promotions -at- camfm . co . uk to claim a prize, stating their name, telephone number, address, and nature of affiliation with the university. After this date Cam FM may give the prize to another winner or retain the prize at our discretion.
- The prize winner is responsible for collection of the prize, or for postage costs unless otherwise explicitly specified in the competition Specific Terms.
- If the prize is an attendance at the event, neither Cam FM nor the sponsor are liable if the participant is unable to attend the event due to any circumstances including but not limited to: prior engagement, ill health, inability to find venue, transportation difficulties, age restriction at the venue, court order or injunction.
- Participants give Cam FM express consent to publicise their name and photograph as the winner of a competition, unless the participant explicitly states a wish to retain their anonymity when submitting their entry.
- Participants give Cam FM express consent to pass their name, address, telephone number, age and/or e-mail address to third party sponsors for the purposes of supplying the prize to a winner and promoting their association with the Competition only. Cam FM is not liable for misuse of personal information by sponsors, and in the unlikely event of misuse, we will report the matter to the Information Commissioner for your protection.
- Rights of Termination and Exclusion of Liability:
- A failure by Cam FM to enforce General Terms or Specific Terms shall not give rise to any claim or right of action by participants or the prize winner
- TO THE MAXIMUM EXTENT PERMISSIBLE BY LAW, CAM FM DISCLAIMS ANY LIABILITY TO ANY ENTRANT, PARTICIPANT, OR PRIZE WINNER ARISING FROM ANY CAM FM COMPETITION HOWSOEVER CAUSED; INCLUDING BUT NOT LIMITED TO: COSTS, EXPENSES, DAMAGES, UNCLAIMED PRIZES; EXCEPT WHERE SUCH LOSS IS DEATH OR PERSONAL INJURY DIRECTLY CAUSED BY OUR NEGLIGENCE.
